SmartlyQ
This policy sets the lowest price at which the SmartlyQ platform, including any white-labeled version of it, may be publicly advertised by resellers and partners.
SmartlyQ invests heavily in building, maintaining, and marketing an AI-powered marketing platform. To protect the value of the platform and the businesses of everyone who resells it, this Minimum Advertised Price Policy (the "MAP Policy") sets the lowest price at which the SmartlyQ platform (including any white-labeled version of it) may be publicly advertised.
This MAP Policy governs advertised pricing only. It does not set the price you charge your customers, and it does not require you to sell at any particular price. You remain free to set your own retail prices and to offer private discounts as described below.
This MAP Policy applies to every partner who resells, rebills, or white-labels access to the SmartlyQ platform, including:
It applies in every country where such a policy is permitted by local law.
You may not publicly advertise access to the SmartlyQ Core Platform at a price lower than:
EUR 97 per month (or the equivalent for annual or other billing periods).
Currency: For advertising in a currency other than EUR, convert using a reasonable, current exchange rate and review it periodically so your advertised price does not fall below the minimum after currency movement.
Bundles: If you advertise the Core Platform as part of a bundle, the advertised price of the whole bundle must be at least the minimum above. You may not give away Core Platform access "for free" alongside a separately priced feature to work around this policy.
The "Core Platform" means any offering that includes two or more of the following SmartlyQ capabilities:
An offering that provides only a single one of these capabilities on its own is not treated as the Core Platform and is not covered by the minimum price.
This policy restricts the price you advertise in public, not the price a customer actually pays. You may charge below the minimum in a genuine private transaction, provided the discounted price is not publicly discoverable.

Partners advertising to consumers in the EU or UK may state that the final price a customer pays could differ from the advertised price, consistent with local consumer-pricing law. This does not change the minimum advertised price itself.
If you believe a partner is advertising below the minimum, report it to legal@smartlyq.com. Reports may be submitted confidentially. SmartlyQ reviews each report but does not disclose the details or outcome of any investigation. Reviews can take several weeks.
SmartlyQ enforces this policy at its discretion. Depending on the circumstances, enforcement may include a warning and a request to correct the advertised price, suspension of white-label or reseller privileges, or termination of the partner's account in line with the SmartlyQ Terms of Service.
SmartlyQ is not granting MAP Policy exceptions at this time. SmartlyQ reserves the right to grant an exception in writing, at its sole discretion, on a case-by-case basis. Any exception must be in writing from SmartlyQ to be valid.
SmartlyQ may update this MAP Policy from time to time. The current version is always the one published at smartlyq.com. Material changes will be communicated to active reseller and white-label partners.
