1. The Program

The SmartlyQ affiliate program (the "Program") lets you earn commissions by referring new customers to SmartlyQ. By joining the Program you agree to these Affiliate Program Terms, to the SmartlyQ Terms of Use, and to the Content Policy. If these terms conflict with the Terms of Use, these terms control for the Program only.

Joining is free and open to SmartlyQ customers and non-customers alike. We may review applications and accounts at any time, and we may decline or remove participants at our discretion.

2. Referrals and Attribution

• You receive a unique referral link. A referral is attributed to you when a new customer signs up through your link.
• Attribution lasts 30 days from the click. If the visitor subscribes within that window, the referral is yours; if several affiliates referred the same visitor, the most recent click before signup wins.
• Only genuine, new customers count. Existing accounts, duplicate accounts, and reactivations of previous customers are not qualifying referrals.

3. Commissions

• You earn a 30% recurring commission on the subscription payments made by customers you referred, for as long as they remain paying customers.
• Commissions accrue on subscription plan payments. Usage credits, one-time top-ups, taxes, and refunded or charged-back payments do not accrue commission.
• If a referred customer receives a refund, or a payment is reversed, the corresponding commission is deducted from your balance.

4. Payouts

• Commissions are paid monthly, via PayPal or bank transfer, within 30 days after the end of the month in which they were earned.
• There is no minimum payout threshold.
• You are responsible for providing accurate payout details and for any taxes on your commission income in your jurisdiction.

5. Permitted and Prohibited Promotion

We want affiliates to promote SmartlyQ honestly, to audiences that trust them. The following are prohibited and result in forfeited commissions and removal from the Program:

• Self-referrals: signing up your own accounts, or accounts you control, through your link.
• Misleading claims: fabricated results or testimonials, income guarantees, fake discounts, or presenting yourself as SmartlyQ itself.
• Spam: unsolicited bulk email or messages, or posting your link where it is not welcome.
• Brand bidding: bidding on "SmartlyQ" or confusingly similar terms in paid search, or using our trademarks in domain names, handles, or app names.
• Cookie stuffing, forced clicks, or any manipulation of attribution.
• Coupon or incentive abuse: offering unauthorized rebates, cash-backs, or coupon codes.
• Promotion alongside content that violates our Content Policy.

You must clearly disclose your affiliate relationship where the law requires it (for example, FTC-style disclosures).

6. Program Changes and Termination

• We may update commission rates, attribution rules, or these terms prospectively. Material changes will be announced to active affiliates; continued participation after a change means you accept it.
• Either side can end participation at any time. On termination for a violation of Section 5, unpaid commissions from the violating activity are forfeited. On ordinary termination, validly earned commissions are paid out on the normal schedule.
• We may withhold commissions during a fraud review, and permanently where fraud is confirmed.

7. Relationship

Affiliates are independent parties, not employees, agents, or representatives of SmartlyQ. You may not make commitments on our behalf, and nothing in the Program creates a partnership or joint venture.
