SmartlyQ gives you AI that can research, write, design, build websites, and publish on your behalf. This policy explains what you may and may not create, generate, publish, or send with SmartlyQ, and how we enforce these rules.
SmartlyQ is built to help real businesses grow: creating content, building websites and funnels, managing customers, and communicating with audiences. The same capabilities that make SmartlyQ powerful could be misused, so this Content Policy sets clear boundaries.
This policy applies to everything you do with SmartlyQ, including:
It applies to prompts you submit, content the AI generates at your direction, content you upload, and content you publish or send. This policy supplements our Terms of Use; if the two conflict, the Terms control.
We want SmartlyQ to be the most capable marketing platform you can use, and we believe capability and safety go together. Our AI features include built-in guardrails that refuse requests which violate this policy, and our systems and team review reported content. We aim to enforce these rules consistently, proportionately, and with a path to appeal.
You may not use SmartlyQ, including any AI feature, to create, generate, request, upload, publish, host, or distribute content or activity in the categories below.
Anything that violates applicable law, or that plans, facilitates, or conceals illegal activity. This includes money laundering, trafficking, sale of stolen goods or data, and evasion of sanctions or export controls.
We apply zero tolerance here. Any content that sexualizes, exploits, endangers, or abuses minors is prohibited, including fictional, drawn, or AI-generated depictions, grooming behavior, and content that facilitates child abuse in any form. We report apparent child sexual abuse material to the relevant authorities.
Content that incites, glorifies, or provides instructions for violence against people or property; content produced by or in support of terrorist or violent extremist organizations; or recruitment and propaganda for such groups.
Content that promotes, encourages, or provides instructions for suicide, self-injury, or eating disorders, or that exploits people in crisis.
Content that dehumanizes, demeans, or promotes discrimination or violence against people based on protected characteristics such as race, ethnicity, religion, nationality, disability, gender, sexual orientation, or serious disease. Also prohibited: targeted harassment, bullying, threats, and coordinated abuse of any individual.
Because SmartlyQ can build and host real websites and send real messages, we are strict here. Prohibited uses include:
Presenting yourself as another real person or organization without authorization, including cloned websites, forged sender identities, fake official notices, and AI-generated voices or likenesses of real people used without their consent.
Creating or distributing malware, ransomware, spyware, or exploit code; building tools for unauthorized access to systems, accounts, or data; denial-of-service activity; or using SmartlyQ infrastructure to attack, probe, or abuse other systems.
Collecting, exposing, or exploiting personal data without a lawful basis. This includes doxxing, stalkerware or covert tracking, scraping personal data in violation of law or platform terms, and non-consensual surveillance of individuals.
Publishing or distributing content that infringes copyrights, trademarks, or other proprietary rights, including counterfeit goods and unauthorized copies of paid content. Rights holders can report infringement using the contact in Section 8.
Creating, hosting, or distributing pornographic or sexually explicit content, sexual services, or non-consensual intimate imagery, including AI-generated intimate imagery of real people.
Instructions for creating weapons, explosives, or chemical, biological, radiological, or nuclear threats; and the marketing or sale of illegal weapons, illegal drugs, or other goods whose sale is prohibited where you operate.
Knowingly spreading false information likely to cause harm, including medical misinformation that endangers health, content designed to interfere with elections or civic processes, and deceptive synthetic media presented as authentic.
Bulk or automated messaging to people who have not consented, purchased or scraped contact lists, engagement manipulation, artificial traffic, and any attempt to evade SmartlyQ's usage limits, billing, safety systems, or the rules of platforms you connect to SmartlyQ.
Using AI output as the sole basis for decisions with legal or similarly significant effects on people, such as credit, employment, housing, insurance, medical, or legal decisions, or presenting AI output as licensed professional advice.
Websites, funnels, and pages published through SmartlyQ run on infrastructure we operate or pay for, so additional rules apply:
When you use SmartlyQ to send email, SMS, voice calls, or social messages, you must comply with the laws that apply to those communications, including consent, sender identification, and opt-out requirements (such as the GDPR and ePrivacy rules in the EU). Honor unsubscribe requests promptly and never message purchased, scraped, or non-consented lists. Carrier and platform rules apply in addition to this policy.
Enforcement is proportionate to the harm involved:
For severe categories, including child safety, terrorism, and active fraud against third parties, we act immediately and without prior notice.
If you believe we removed content or restricted your account in error, contact support@smartlyq.com with the subject "Policy appeal", the affected content or feature, and why you believe the action was mistaken. We review appeals and respond as quickly as we can.
If you find content created or hosted with SmartlyQ that appears to violate this policy, report it to support@smartlyq.com with the subject "Content report" and a link to the content. Reports may be submitted confidentially. Rights holders may use the same address for infringement notices.
We may update this Content Policy from time to time as our features, the law, and best practices evolve. The current version is always the one published at smartlyq.com. Material changes will be announced through the platform or by email.
